Privacy Policy

In recognition of the importance of personal information, Yamaoka Memorial Foundation (hereinafter referred to as “Foundation”) considers that Foundation has its social responsibility to handle accurately and confidentially any personal information.

Foundation hereby establishes its privacy policy as stated bellow (hereinafter referred to as “Privacy Policy”) and declares that Foundation complies with its Privacy Policy.

For persons in the European Economic Area (the "EEA"), please refer to Privacy Policy for Related Persons in EEA.

1) Collection of Personal Information

For purposes of this Privacy Policy, “Personal Information” means the name, address, telephone number, e-mail address and other information by which an individual can be identified. Foundation collects Personal Information through legal and fair means.

When Foundation requests you to provide your Personal Information, Foundation gives you prior notice of the purpose and the way of use of such Personal Information. Foundation collects Personal Information to the extent necessary for performing its legal activities and achieves its objects.

2) Use of Personal information

Foundation uses Personal Information only as needed for the purpose of collection of such information and within the scope of consent obtained from the person who provides Personal Information (hereinafter referred to as “Provider”).

Foundation may use relevant portions of your Personal Information in order to:

  • contact you when necessary for performing Foundation’s activities
  • provide you with information relating services provided by Foundation
  • provide you with information relating seminars and events held (sponsored, cosponsored, supported, assisted) by Foundation
  • respond and take necessary actions to requests for information and services from Provider
  • perform purposes notified to and consented by Provider prior to collection of such Personal Information

If Foundation is required to use Personal Information for the purpose other than as listed above, unless allowed by applicable laws and regulations, Foundation shall obtain prior consent for such use from Provider of such Personal Information.

3) Using Subcontractor for Administering Personal Information

Foundation may use subcontractor for information processing and other matters in order to provide better services to Provider.

Foundation shall contract with appropriate subcontractor properly handling Personal Information and ensure that such subcontractor properly performs its obligation to administer Personal Information.

4) Disclosure to Third Party

Foundation will not disclose Personal Information to any third party except for providing subcontractor without obtaining consent from Provider. Provided however when applicable laws and regulations require the disclosure, Foundation may disclose Personal Information to respond such requirement.

5) Request for Disclosure, Correction, Deletion, etc.

You may request to obtain confirmation concerning whether Foundation is holding or processing Personal Information relating to you, and confirmation concerning the use of the Personal Information in possession of Foundation.

You may request to correct, add or delete your Personal Information. Such request may be submitted to Foundation by using e-mail: yamaoka-memorial@yanmar.com. If such a request is made, Foundation requires that your proof of identity should be provided. When Foundation finds it necessary to disclose and unless such disclosure will not cause considerable harm to Foundation’s operation, Foundation will disclose your Personal Information in possession of Foundation to you to a reasonable extent and in a reasonable period of time.

You may request to correct, add or delete your Personal Information. If such a request is made, Foundation requires that your proof of identity should be provided. When Foundation finds it necessary to correct, add or delete, and unless responding such request will not cause considerable harm to Foundation’s operation, Foundation will correct, add or delete your Personal Information in possession of Foundation to a reasonable extent and in a reasonable period of time.

6) Fee for Disclosure of Personal Information

Foundation may request you to pay a fee for disclosure of your Personal Information by giving prior explicit notice to you about the fee. You must prove your identity in order to make such requestt.

7) Compliance with Laws and Regulations relating to Personal Information

In recognition of the importance of Personal Information, Foundation complies with the laws and regulations in order to ensure the protection of Personal Information. This Privacy Policy shall be governed by and construed in accordance with the laws and regulations of Japan.

8) Security

Foundation shall make every effort to prevent the loss, destruction, alteration, leaking of or illegal access to Personal Information. As measures for security management of all Personal Information, Foundation shall establish the appropriate system to ensure the effectiveness of the security management

Foundation shall limit entries to the place where Personal Information is stored and administered, inculcate the Privacy Policy and legal requirement on its corporate directors, officers and employees through education and appoint a person to supervise Personal Information protection within the Foundation and ensure the effectiveness of the security management.

9) Updating the Privacy Policy and Improving the Protection

Foundation shall continuously update, modify and improve this Privacy Policy and the effectiveness of the security management in order to follow to changes of Japanese laws and regulations and social circumstances.
